Emmelev A/S’ General Data Privacy Notice
Emmelev A/S (hereafter “Emmelev”) produces biodiesel, rapeseed oil, rapeseed cakes, rapeseed seeds, and glycerin. Some of Emmelev’s customers and suppliers are sole proprietorships. Information about sole proprietorships falls under the scope of the General Data Protection Regulation (GDPR) and the Data Protection Act, where sole proprietorships are regarded as data subjects.
Below, we describe how we process information about sole proprietorships, and we refer to sole proprietorships as “you/your.”
1. Who is responsible for processing your personal data?
Emmelev A/S, Emmerlevgyden 25, 5450 Otterup with CVR no.: 54449712 determines the purposes and means of processing your sole proprietorship’s information. Therefore, Emmelev is the “data controller” under data protection regulations. 2. What is the purpose of processing your sole proprietorship’s information?
To serve its current and potential customers registered as sole proprietorships, Emmelev needs to process various information about these businesses.
Serving potential customers involves responding to inquiries, providing price estimates, and drafting contracts.
Serving current customers requires responding to various inquiries, drafting contracts, recording deliveries, arranging transport, issuing invoices, and making any necessary financial claims.
Emmelev also processes information about sole proprietorships that supply raw materials to manage deliveries, which includes responding to inquiries, drafting contracts, recording received deliveries, and handling invoicing.
Additionally, Emmelev has ongoing correspondence with sole proprietorships regarding potential deliveries.
3. What personal data does Emmelev process and on what basis?
To serve current customers, handle inquiries from potential customers, and manage received raw material deliveries, Emmelev needs to process information about sole proprietorships’ names, their employees’ names, contract details, CVR numbers, and addresses.
For current customers and suppliers, Emmelev also processes information about their banks, the specific contract in question, handling of deliveries, and specific inquiries.
Processing of this information is necessary to fulfill a contract or take steps prior to entering into a contract to which the sole proprietorship is a party, pursuant to GDPR Article 6(1)(b).
4. Who are the personal data disclosed to?
Emmelev does not disclose information about potential customers and suppliers. Emmelev’s accountant receives information about the issuer, recipient, nature of orders and deliveries, related contracts, and invoices.
The selected transport company receives information about the delivery address, recipient, and nature of the freight.
In case of a dispute between Emmelev and its customer or supplier, Emmelev discloses information about the subject of the dispute to its lawyer.
5. How long will personal data be retained?
Information about potential customers and suppliers (i.e., sole proprietorships’ names, contract details, CVR numbers, and addresses) is deleted as soon as inquiries are answered and are no longer current.
Information about recipients of Emmelev’s deliveries and the nature of those deliveries is retained for 10 years due to the requirements of the CO2 certification scheme.
Information about raw material deliveries received by Emmelev is also retained for 10 years due to the CO2 certification scheme.
Contracts between Emmelev and its customers and suppliers, as well as invoices for the given and received deliveries, are retained for 5 years.
Information involved in any dispute, such as financial claims, is retained as long as the dispute is unresolved.
6. Your rights as a data subject.
As a data subject, you have a number of rights under the GDPR, which you can exercise by contacting Emmelev directly.
Right of access:
Under GDPR Article 15, you have the right to access the data we process about you, as well as additional information.
Right to rectification:
Under GDPR Article 16, you have the right to have incorrect information about yourself corrected.
Right to erasure:
In certain circumstances, under GDPR Article 17, you have the right to have information about you deleted before our regular general deletion time.
Right to restriction of processing:
In certain cases, under GDPR Article 18, you have the right to restrict the processing of your personal data. If you have the right to restrict processing, we may, aside from storage, only process the data with your consent, for the establishment, exercise, or defense of legal claims, to protect another person, or for reasons of important public interest.
Right to data portability:
In certain cases, under GDPR Article 20, you have the right to receive your personal data in a structured, commonly used, and machine-readable format and to have these personal data transferred from one controller to another without hindrance.
7. Complaints to the Data Protection Authority.
